Digital Asset Consultants, Inc. (DACAIS) and its affiliates, including AITalentSolution.com, Inc., are not liable for any damages, losses, or issues arising from the use of our services, products, or software. This includes but is not limited to direct, indirect, incidental, consequential, or punitive damages.

Refunds and Discounts Policy

All refunds and discounts are evaluated on a case-by-case basis and are solely at the discretion of Digital Asset Consultants, Inc. There is no automatic right to refunds, credits, or discounts unless explicitly authorized in writing by an authorized representative of Digital Asset Consultants, Inc.

No Guarantees: There is no 30-day satisfaction guarantee, money-back guarantee, or free trial period unless specifically authorized in writing by Digital Asset Consultants, Inc. Any trial periods or guarantees must be explicitly documented in a signed agreement.

Customer Data and Property Responsibility

Customer Responsibility

The customer is solely responsible for all customer-owned data, property, source code, intellectual property, and any other assets provided to or used with Digital Asset Consultants, Inc. services.

  • All customer data must be completely backed up prior to service implementation
  • Customers must verify compatibility of our services with their operations
  • Customers are responsible for the security and integrity of their data
  • Any loss of customer data is the sole responsibility of the customer

DACAIS Commitment

While Digital Asset Consultants, Inc. will use reasonable efforts to ensure compatibility and security of our services, all liability for data loss, corruption, or incompatibility rests solely with the customer. DACAIS makes no guarantees regarding data preservation or system compatibility.

Contract Enforcement and Terms

Contract Duration

All contracts with Digital Asset Consultants, Inc. are enforceable for the following standard terms:

  • 1 Year contracts
  • 2 Year contracts
  • 3 Year contracts
  • 5 Year contracts

Breach of Contract

In the event of contract breach by either party, all remaining payments will be strictly enforced and continue to be billed unless otherwise agreed upon in writing by Digital Asset Consultants, Inc. due to extraordinary circumstances or mutual agreement. Early termination does not relieve the customer of payment obligations for the full contract term.

Intellectual Property and Proprietary Rights

Sole Ownership

All services, software, products, and related materials provided by Digital Asset Consultants, Inc., including but not limited to:

  • Software as a Service (SaaS) applications
  • AI and machine learning models
  • Source code and algorithms
  • Hardware and infrastructure components
  • User interfaces and design elements
  • Icons, graphics, and visual assets
  • Documentation and training materials
  • Any proprietary processes or methodologies

All such materials are the sole and exclusive property of Digital Asset Consultants, Inc. and are protected by intellectual property laws, including copyright, trademark, and trade secret protections.

Prohibited Actions and Consequences

Strictly Prohibited

The following actions are strictly prohibited and may result in immediate termination of services, legal action, and pursuit of all available remedies:

  • Theft, copying, or reproduction of any source code
  • Reverse engineering of software or algorithms
  • Unauthorized access to systems or data
  • Distribution or sharing of proprietary materials
  • Creation of derivative works without explicit permission
  • Removal or alteration of copyright notices
  • Any attempt to claim ownership of DACAIS intellectual property

Service Compatibility and Implementation

Pre-Implementation Requirements

Before engaging Digital Asset Consultants, Inc. services, customers must:

  • Verify that our services are compatible with their existing systems
  • Ensure all data is properly backed up
  • Test our services in a non-production environment if possible
  • Confirm that their infrastructure meets minimum requirements

While DACAIS will make reasonable efforts to ensure compatibility and security, the customer bears sole responsibility for verifying suitability and maintaining backups of all critical data.

Governing Law and Jurisdiction

All disputes arising from these disclosures or related services shall be governed by the laws of the jurisdiction where Digital Asset Consultants, Inc. is incorporated, without regard to conflict of law principles.

By using Digital Asset Consultants, Inc. services or products, you acknowledge that you have read, understood, and agree to be bound by these legal disclosures. These terms supersede any other communications or agreements unless explicitly stated otherwise in writing by an authorized representative of Digital Asset Consultants, Inc.
